ICS Website Terms and Conditions

 

These Online Terms and Conditions are a contract between you and iComputing Solutions Limited, doing business as ICS. ICS is referred to in these Online Terms and Conditions as “ICS”. These Online Terms and Conditions apply when you use the ICS website (located at www.myics.co.za), buy any products or services through the ICS website and also apply to your use of any such goods and services. By accessing the ICS website you agree to these Terms and Conditions. If you do not agree to these Online Terms and Conditions you must not use the ICS website.

 

Disclaimer and limitation of liability

The information, content, services, and features of the ICS website, including text, graphics and links are provided on an “as is” basis. ICS does not represent that the ICS website or any content, service or feature of the website will be error free, or will meet any particular criteria of accuracy, completeness or reliability of information, performance or quality. ICS does not give any warranty, express or implied, in relation to the operation of the ICS website.

ICS cannot ensure that any files or other data that you download from the ICS website will be free of viruses or contamination or destructive features.

ICS is not responsible for the acts or omissions of any third parties in connection with the use of the ICS website.

ICS is not liable for any damages, liability or harm caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of the ICS website, whether for breach of contract, delict, or any other cause of action.

ICS is not liable for any indirect, consequential, special, incidental or punitive damages, including lost profits, even if ICS has been advised of the possibility of such damages.

If, despite the exclusion of ICS’ liability in these Online Terms and Conditions, ICS is found to be liable for any loss or damage caused, ICS’ liability is limited to R1000.

These Online Terms and Conditions do not affect your statutory rights, including your rights under any applicable consumer laws that cannot be altered by contract.

 

Content on the ICS website

All content on the ICS website, such as information, text, pictures, photographs, graphics, interfaces, and the design, structure and arrangement of the content, belongs to ICS or is licensed to ICS and is protected by law. You may not copy, reproduce, upload or post any of the content on the ICS website without ICS’ prior written permission.

 

Links to third party websites

The ICS website may include links to websites operated by third parties. ICS is not responsible for the content of those sites. The links to third party websites from the ICS website do not imply any responsibility for the content, opinions, representations, products or services provided on those sites. You are responsible for complying with the terms of use of any linked third party websites.

 

Changes to ICS website

The content on the ICS website and the products and services offered may change from time to time. No notice of any changes will be given to you. ICS may also interrupt the operation of the ICS website, or any part of the website, to perform routine or non-routine maintenance, to correct any errors, or make other changes.

 

Termination

If you do not comply with these Online Terms and Conditions when accessing or otherwise using the ICS website, ICS has the right to suspend your access to the website temporarily or permanently without notice to you. ICS may also stop operating the website entirely.

 

Sales in South Africa only

Only users in South Africa may buy goods and services through the ICS website. ICS will only accept orders for delivery addresses in South Africa. Products and services sold through the ICS website are intended for use only in South Africa.

Age
 – By using the ICS website you are representing that you are above the age of 18 or, if you are below the age of 18, that you have the permission of your parent or guardian to use the ICS website and to buy goods and services through the website.

 

Billing and personal information

In order to buy goods and services through the ICS website, you will need to register an online account with ICS. For this purpose you will need provide to ICS certain personal information and billing information that will enable ICS to charge you for your purchases (such as your credit or debit card details). You must provide accurate and complete registration information when you register an account. You must ensure that your registration information is kept up-to-date. Any personal information or billing information that you provide to ICS will be used and retained in accordance with ICS’ Privacy Policy. The Privacy Policy can be accessed at [insert URL to Privacy Policy] and forms part of these Online Terms and Conditions.

When you set up your account you will choose a user name and password. You will have to use these details to log in to your account. You are responsible for keeping these details confidential. You must notify ICS immediately if there is any unauthorized use of or access to your account. ICS will not be responsible for any unauthorized use of your user name and password or for any losses that you suffer as a result and you will be responsible for any purchases made using your account, where you have failed to keep your user name and password secure and confidential. You may be held responsible for any losses suffered by ICS or any other user of the ICS website as a result of your failure to keep your user name and password secure and confidential.

 

Order process

When you place an order for a product, your order is subject to product availability. If, after you place your order, there is insufficient stock to fulfill your order, ICS has the right to cancel your order or any part of your order and refund the purchase price. ICS will refund the purchase price based on the original payment method (i.e. to your credit or debit card). You will have the opportunity to review any order for products or services that is placed through the ICS website. You can withdraw your order at any time before finally placing it. ICS reserves the right to refuse to process an order or not to accept a confirmed order in the event of a technical or any other error in the price displayed or in the product information displayed at the time the order was proceeded. The customer will be refunded any moneys paid should an order not be accepted.

 

Payment processing

All transmissions of billing information and data through the ICS website are encrypted and

ICS takes extensive steps to ensure that any transaction through the ICS website is secure. You accept that transactions that are performed over the internet may be vulnerable to being intercepted. ICS will not be liable for any interception that occurs and any loss that is suffered as a result, where ICS has taken reasonable steps to prevent this happening.

 

Terms and conditions of sale and return and refund policies

ICS will refund or exchange any online purchases within 7 days from the date of receipt as long as the item has not been used or installed and is returned in the original packaging and that the relevant proof of purchase is provided.

A 10% handling fee may be charged on opened / used purchases.

Software products cannot be exchanged or refunded. Products will not be refunded or exchanged due to incompatibility. Please check compatibility information before placing an order. A courier collection fee of R100.00 may be charged on refunds and exchanges. ICS will refund the purchase price of any product within 30 days after you cancel your agreement with ICS.

ICS will give you a refund based on the original payment method used to buy the products.

If you have entered into a contract with a mobile cellular operator for a data package and/or to buy a device, returning a product bought through the ICS website will not cancel your contract with the mobile cellular operator. You will continue to be responsible for that contract and for any charges and fees that are associated with that contract. Your right to return products that you bought through a contract with a mobile cellular operator and your right to cancel are governed by your contract with the mobile cellular operator.

Where you buy services though the ICS website, you agree that ICS can start providing the services before 7 days have passed from the date that you bought the services.

 

Pricing changes

ICS reserves the right at any time and without giving you any advance notice to make changes to the prices of goods and services that are sold through the ICS website and to correct any pricing errors that may inadvertently occur. ICS is not liable for any typographical errors that may occur.

 

Changes to the contract 

ICS reserves the right to make changes to these Online Terms and Conditions at any time.

If you are an existing customer, ICS will notify you in advance of any material changes that it intends to make to these Online Terms and Conditions before the changes come into effect. If you do not wish to be bound by the amended contract, you should not continue to use the ICS website.

Delivery and collection

ICS will perform deliveries. You may be required to provide a valid form of identification when your order is delivered.

ICS is not liable for any incorrect order or delivery where you make an error in the information that you provide to ICS e.g. if you provide the incorrect delivery address or submit an incorrect order.

You acknowledge that the delivery of your order may be impacted by events beyond ICS’ control such as adverse weather conditions or industrial action. ICS is not liable for late deliveries of products purchased through the ICS website. ICS will, however, try to ensure a smooth delivery process.

 

Other terms and conditions

Additional terms and conditions may apply to specific products and services that are made

available through the ICS website and to other features that are made available on the site such as competitions. Those terms and conditions form part of these Online Terms and Conditions and you agree that you are bound by them. If there is a conflict between these Online Terms and Conditions and any specific terms and conditions applicable to any particular product or service or feature of the ICS website, the specific terms and conditions will apply.

 

Pre-Orders

ICS Online will from time to time allow customers to place Pre-Orders online.

These Pre-Orders are to “secure” launch products as soon as they are made available at ICS Online
 Pre-Orders require 100% full payment to be cleared in our system. 
EFT payments are subject to the standard terms and conditions of EFT payments.

Pre-Orders will be fulfilled as and when ICS Online receive inventory from the supplier. ICS Online will make every effort to fulfill your Pre-Order and in the unlikely event that we cannot supply product against your Pre-Order you will be refunded your payment. Pre-Orders are restricted to one order per customer.

Pre-Orders placed online may not be collected in a physical ICS branch.

Interpreting the contract, governing law and dispute resolution

These Online Terms and Conditions are governed by the laws of South Africa, regardless of conflict of laws principles.

A court may find that some of the provisions of this contract are not enforceable. If this occurs, the remaining provisions of the contract will continue to apply. ICS will replace the affected provisions with new provisions that achieve the intended purpose but that are capable of being enforced in your country. 

You and ICS consent to the exclusive jurisdiction of the High Court of South Africa, Johannesburg for all disputes arising out of or relating to this contract. If you make a claim under your contract with ICS, as set out in these Online Terms and Conditions, you must do so within one year of the date when the cause of action arises. If you do not do so, your claim will be barred.

 

Record of your transaction

If you need to obtain a sales record of your transaction to buy goods or services through the ICS website, you can contact ICS within 30 days of the transaction.

 

Complaints and notices

Any legal notices that you give ICS under this contract must be sent by registered post to 204 Florida Rd Morningside 4001 Durban.

Where ICS needs to give you any notice as provided for in this contract or provide additional information about the products and services supplied to you, ICS will do so by sending you an email or posting a notice on the ICS website. You consent to ICS providing you with notices or information in this way.

 

Pre-Owned Shop Terms and Conditions:

The ICS Pre-Owned shop does not offer training or technical support, ICS Pre-Owned Shop customers will however still be able to access training and technical support at all other ICS branches. The Pre-Owned Shop does not offer cellular contracts, trade-in, or iCare products. ICS promotions and special offers are not redeemable in the ICS Pre-Owned shop. Stock may vary and availability can only be confirmed upon visiting the Pre-Owned Shop. Stock is limited and will be sold on a first come first served basis.  Only debit and credit cards will be accepted. ICS Gift Cards will not be accepted at the Pre-Owned Shop.

 

Warranty:

All products bought at the Pre-Owned shop are sold with a warranty. Mac, iPad, iPhone and Apple Watch are sold with a 12 month warranty. All other products are sold with a 6 month warranty.

 

Pre-Owned shop – Returns, refunds and exchanges…

You may return unopened and fully sealed products purchased at the ICS Pre-Owned shop and receive a full refund of the purchase price within the first 7 days of the invoice date. You will only be eligible for a refund if the product is returned to the ICS Pre-Owned shop together with the original tax invoice. You will only be eligible for a refund if the product is returned to ICS together with all its accessories, the original product packaging, original tax invoice and subject to an Internal inspection of the product at our Service Centre. This excludes any bulk deals over five units. ICS will not facilitate any bulk deal returns. All faulty products will be covered in the relevant product warranty.

Where you are eligible for a refund, the purchase price will be refunded to your credit card or, if you paid using another payment method, by electronic funds transfer (EFT) to your bank account. For this purpose you may be required to provide your bank account details to ICS. EFT payment takes 14 working days to process

Unsealed software products, software subscriptions, gift cards and In-ear products may not be returned to ICS and are not eligible for refunds.

ICS Sales Terms and Conditions

Returns, refunds and exchanges

You may return unopened and fully sealed products purchased at any ICS and receive a full refund of the purchase price within the first 7 days of the invoice date. You will only be eligible for a refund if the product is returned to ICS together with the original tax invoice. If an item is purchased via the online store a refund can not be processed in a physical store. Should you wish to receive a refund please email a request to enquire@myics.co.za. You may return opened and unsealed products purchased at an ICS physical store and receive a refund of the purchase price less 10% within 10 days of the date of purchase. ICS levies a charge on returns of unsealed products to cover the costs of repackaging the product for sale. You will only be eligible for a refund if the product is returned to ICS together with all its accessories, the original product packaging, original tax invoice and subject to an Internal inspection of the product at our Service Centre. This excludes any bulk deals over five units. ICS will not facilitate any bulk deal returns. All faulty products will be covered in the relevant product warranty. Warranties

The products and services that are sold by ICS are sold “as is” and “as available”. ICS does not give any express guarantee or warranty regarding the performance of any product or services and excludes any implied warranties to the full extent that is permitted by law.  The manufacturers of the products sold by ICS may provide a manufacturer’s warranty in respect of their branded products.  This manufacturer’s warranty is not given by ICS although ICS may be responsible for providing certain warranty service under this manufacturer’s warranty in terms of its arrangements with those manufacturers.

In the event of a device requiring service you are responsible to ensure that any screen protector, cover or third party add-on is removed prior to obtaining service.

The ICS will not be held liable for the cost to replace any third party add-on’s such as “Screen protectors, Covers etc” as these will have to be removed in order to facilitate any form of service / assessment.

Business terms and conditions

Quotations are valid for 24 hours, however due to the volatility of the Rand/USD & Rand/Euro exchange rate, please note that prices published by iComputing Solutions (ICS) may change without notice.

 

Pre-Order terms and conditions

Pre-Orders allows you to secure a newly launched product prior to availability in-store.

Pre-Orders can only be secured by completing an full payment or a deposit payment. ICS may choose to use one or all payment options.
Full payment Pre-Orders are prioritised. ICS will endeavor to ensure that Pre-Orders will be fulfilled as soon an inventory is available, however on occasion there may be delays due to supply constraints.

Should you wish to change or cancel your Pre-Order, you will need to follow the current ICS refund process. Please refer to our refund and return funds section in our terms and conditions

Pre-Orders will be delivered by courier only. You will not be able to collect your Pre-Order from an ICS branch.

 

Trade-in terms and conditions

Exclusive to ICS in South Africa. All rights reserved. Mac Trade-in is completed in-store only.

The value of the trade-in during the in-store valuation process is subject to the applicant being the lawful owner of the device and the device being in good working order, with no damage whatsoever to the screen, no liquid damage, no damage to the outer shell, including any scratches or small dents, and the device has not had any unauthorised repairs. ICS may decrease the amount of the trade-in valuation if the above conditions are not met or are found to be untrue.

A reduced cashback amount will be paid if the working Apple charger/power cable does not accompany the device when trading it in.
A second evaluation will be completed at the ICS central processing centre and should the second evaluation be significantly different to the in-store assessment the applicant will be contacted and offered an amended trade-in value or arrangements will be made to return the device.
Assessment results are final.

All user data must be removed from the device.

One Mac may be traded in against one new/upgrade iPhone/Mac/iPad/Watch purchase, either on cash or cellular contract purchase if applicable.

If the device to be traded in is linked to a cellular contract, the trade-in can only occur if the device you are trading is linked to a cellular contract older than 6 months, or no money is owed / outstanding towards the payment of the device. Should there be any money owing / outstanding on the device accepting these terms and conditions serves as a declaration that all outstanding money on the device or any obligation to the cellular network for this device will be settled in full, irrespective of whether the device is traded in before the contract expires.

When you buy a new iPhone/Mac/iPad/Watch for cash, take out a new cellular contract, or upgrade an existing contract the trade in amount will be passed as cashback via Electronic Funds Transfer only. Payments will only be made into South African registered bank accounts. Should all above conditions be met allow 14 working days for the committed cash amount to be transferred.

By signing up for this offer you are not ordering a device.

Device Trade-in will not be considered if the serial number on my device has been removed, damaged or hidden or if my device itself has been altered, tampered or meddled with in any way. ICS will not be held liable for any misrepresentation caused due to an unintentional copy error, and/or omission that may occur on any of our material. E&OE.

 

Additional terms and conditions

Additional terms and conditions may apply to specific products and services that sold by ICS.  Those terms and conditions form part of these Terms and Conditions of Sale and you agree that you are bound by them.  If there is a conflict between these Terms and Conditions of Sale and any specific terms and conditions applicable to any particular product or service, the specific terms and conditions will apply.

One promotion can not be used in conjunction with another.

 

ICS Sale 

Terms and conditions apply. Offers valid from 25 May to 11 June 2017 or while stocks last and are not valid in the Pre-Owned store. All products carry a 12-month warranty. Open box units could vary from brand new with opened, shop-soiled or without packaging.

Stock levels may vary by store and can only be checked at your nearest ICS branch. No stock availability will be checked centrally from the call centre, social media or any other customer service channels and no stock will be reserved in-store or through customer service channels – all purchases will be treated on a first come first serve basis. Certain product deals are limited to a certain number of units and once the pre-determined number of units has been reached, the deal will come to an end. Repair Terms and Conditions

 

  • Units can take up to 10 working days to complete.
  • Repairs not collected within 30 days after completion, will be sold to defray costs.
  • Please note workshop hours are Monday – Friday, 8 AM to 5 PM. Collections are to be made between these hours.
  • We are not responsible for the availability of spare parts nor are we responsible for the loan of equipment should a repair take longer than expected.
  • Units that are damaged or scratched upon arrival will be noted on this form. Should you require this to be repaired we will quote accordingly.
  • We accept no responsibility for units that are booked in without the correct packaging as the units will leave after the repair in the same manner.
  • We accept no responsibility for any data loss. Please ensure that you have made a full back-up of all your data before handing your unit in.
  • Payment terms is strictly cash on delivery.
